In Defense of Animals, a group fighting the $42 million, 3.5 acre elephant enclosure planned for the Los Angeles Zoo, just announced the California Supreme Court has ruled that a taxpayer lawsuit that aims to stop the exhibit can proceed. "By its decision, the California Supreme Court upholds the Appellate Court decision in which the justices concluded, in part, that the 'physical characteristics' of an elephant’s enclosure may constitute 'abusive behavior' under California state law." Zoo keepers contend the new space is big enough to accommodate the 11 elephants they plan for the enclosure. [In Defense of Animals--press release not yet on site]
