Ask Curbed: Is An Uncashed Check from 2002 Worthless?

New, 20 comments

Wow, a reader who found a nice sum of money that may be totally worthless. A good real estate lawyer might be needed here.

A reader writes: "I was cleaning out some old boxes today and came across an uncashed check ($1,275.00) for a security deposit refund for my wife's old apartment. The check was dated 5/31/02 and has "check void after 90 days" imprinted on it. While obviously the check itself no longer valid, is the landlord still legally obligated to issue a new check to refund my wife's security deposit, or are we out of luck? Also, I don't expect the landlord to be forthcoming with the money, so the law being on our side is really the only hope here."
